User Agreement

I agree to the terms of this User Agreement (hereinafter referred to as the Agreement) and undertake to fully and unconditionally comply with all of its provisions.

1.1. The website https://www.fiscalcenter.org/ (hereinafter referred to as the Website) is a collection of web pages available on the Internet and united under the domain https://www.fiscalcenter.org/.

1.2. Website Administration – the person specified in Section 10 of this Agreement.

1.3. Registration – conclusive actions that enable any individual who agrees to all provisions of this Agreement without exception to become a User of the Website. Registration is carried out exclusively on a voluntary basis and reflects the true intentions of the User.

1.4. Website User (User) – any individual who has completed the relevant registration form on the Website (independently and/or with the assistance of parents or guardians if the individual is under 14 years of age), and upon completion of the registration process has been assigned a Username (Login) and Password, and who agrees to and undertakes to comply with the terms of this Agreement on their own behalf, on their own behalf with the consent of a parent/legal representative, or on behalf of a minor for whom they are a parent or legal representative.

1.5. Username (Login) – the email address provided by the User during Registration.

1.6. Password – a sequence of characters known only to the User, stored in the System in encrypted form and used together with the Login for User Authentication.

1.7. Authentication – verification of the legitimacy of a User’s remote access request to the Website, carried out using the Login and Password.

1.8. Authorized Access – access granted following successful Authentication.

1.9. Services (both paid and free) – products and/or services offered and/or provided to the User within the operation of the Website for the purpose of implementing its functions and using the results of its operation in accordance with this Agreement. The procedure and conditions for providing paid Services are defined by a separate agreement.

1.10. User Agreement – the text of this Agreement between the Administration and the User. Compliance with the terms of this Agreement is a mandatory condition for the User’s use of the Website.

2.1. This Agreement applies to all Users of the Website, regardless of the purpose of their use, and constitutes a public offer. The provisions of this Agreement apply to Users from the moment of Registration and each subsequent access to the Website using their Login and Password. By clicking the “Register” button, the User expresses full and unconditional acceptance of this Agreement (acceptance of the offer). If the User does not agree with this Agreement or any of its provisions, they must cease using and accessing the Website.

2.2. The current version of this Agreement is available at: https://www.fiscalcenter.org/. The Administration reserves the right to modify or supplement this Agreement at any time without prior or subsequent notice to the User. The User is responsible for monitoring changes to this Agreement and reviewing its current version. Continued use of the Website after any changes or additions to the Agreement constitutes the User’s acceptance of such changes or additions.

3.1. The Administration allows Users to view and download information from the Website solely for personal, non-commercial use, provided that all copyright and related rights notices, as well as other proprietary notices contained in the original materials and any copies thereof, are retained.

3.2. The User agrees to use the Website strictly in accordance with this Agreement.

3.3. It is prohibited to modify the materials/information on this Website, as well as to distribute, display, or use them in any form for public or commercial purposes.

3.4. All textual information and graphic materials published on the Website are the property of the Fiscal Policy Research Center. Trademarks, service marks, and logos displayed on the Website are the property of the Website.

3.7. The User agrees to promptly notify the Administration of any security breaches related to access to the Website or any inaccuracies in the information presented on the Website.

3.8. The materials reflect the views of the authors and do not necessarily reflect the position of the International Renaissance Foundation and the European Union.

3.9. The User agrees to comply with, including but not limited to, Sections 6 and 7 of this Agreement. The User acknowledges that the Administration has the right, at its sole discretion and without prior notice, to restrict the User’s access to the Website in case of violations, including those specified in Sections 6 and 7.

3.10. Links to other resources (websites) provided on this Website are for informational purposes only.

3.11. The Website Administration bears no responsibility for any damages or losses that may result from visiting external websites linked from this Website.

4.1. In accordance with the Law of Ukraine “On Personal Data Protection,” the User grants the Administration consent to process their personal data for the purpose of ensuring civil-law relations, providing/receiving services, and carrying out payments for purchased goods/services. The User agrees that the data controller has the right to grant access to and transfer the User’s personal data to third parties without additional notice, provided the purpose of processing remains unchanged. This includes verification of the information provided during Registration and, if necessary, sharing such information with third parties, including financial institutions and other individuals and/or legal entities.

4.2. When the User registers or otherwise interacts with the Administration on the Website, the Administration collects both personal information and general data.

4.3. Personal information relates to an identifiable individual, such as name, surname, phone number, email address, etc. Such data is obtained only from individuals who provide it knowingly and voluntarily—for example, by registering on the Website or submitting a request for further information. The Administration does not require registration or provision of such data to browse the Website or access its content.

4.4. In order to interact with the Administration, the User must carefully review their rights and obligations regarding personal data processing as set out in Article 8 of the Law of Ukraine “On Personal Data Protection,” as well as this Agreement, and provide full consent to its terms.

4.5. If the User does not agree with any of the terms of this Agreement or the personal data provisions, they must immediately stop using and accessing the Website and its Services.

4.6. The User has the right to withdraw consent to the use of their personal data at any time by sending an email with the subject “Personal Data” to: fiscalcenter.ua@gmail.com.

4.7. Personal data provided during Registration is processed by the Administration and may be used for targeted services and communications. The Administration operates in accordance with this Agreement and applicable Ukrainian law. The Administration acts as the data controller and processor and retains personal data only for as long as necessary to fulfill the stated purposes, as required by law, or until the User deletes or withdraws such data.

4.8. Personal information is provided directly by the User with their knowledge—for example, when registering on the Website or placing an order for goods/services.

4.9. The Administration does not sell, transfer, or disclose Users’ personal information to third parties without prior consent, except as required by Ukrainian law or in the following cases:
4.9.1 to prevent a crime or harm to the Administration or third parties;
4.9.2 to third parties that provide support services enabling Users to access services or orders via the Website.

4.10. The Administration may provide aggregated (non-personal) information about Website visitors (e.g., percentage of male and female users) to advertising agencies, business partners, sponsors, and other third parties for the purpose of improving content and advertising.

5.1. Under no circumstances shall the Administration be held liable for the content of the Website, including any possible errors, or for any form of damage or loss resulting from the use of the Website.

5.2. The Administration shall not be liable for any direct or indirect financial or other losses incurred by Users due to temporary unavailability of the Website caused by scheduled or unscheduled technical or maintenance work, disruptions in internet service providers, computer networks, servers or equipment, unlawful actions of third parties (whether intentional, unintentional, or negligent), actions of the User, or force majeure circumstances. At the same time, the Administration undertakes to make every reasonable effort to restore the Website’s functionality as quickly as possible. The Administration ensures that the Website operates on a 24/7 basis but does not guarantee uninterrupted access due to possible technical issues or maintenance work.

5.3. The Administration reserves the right to modify the design and appearance of the Website, its content, and to change, remove, and/or add Services, software, or any other elements used or stored on the Website, with or without prior notice to the User.

6.1. All materials presented on the Website, including images, software code, logos, graphics, trademarks, audio, photo and video materials, etc., are objects of intellectual property and are protected by law.

6.2. When using the Website, any actions by the User that may harm or violate the intellectual property rights of third parties are prohibited. The User bears full personal responsibility for such actions and undertakes to compensate the Administration and/or the relevant rights holder for all documented damages caused.

6.3. Under no circumstances shall the Administration be held liable for violations of third-party intellectual property rights if such violations were caused by the actions of third parties.

9.1. All disputes between the User and the Administration shall be resolved through negotiations, and in the event that such resolution is not possible, through legal proceedings in accordance with the applicable laws of Ukraine.

9.2. The relations between the Parties under this Agreement shall be governed by the laws of Ukraine.

9.3. The Administration reserves the right to unilaterally amend or update parts of this Agreement at any time without prior notice. The User undertakes to periodically review this Agreement in order to stay informed about any changes or updates. All amendments to this Agreement shall take effect from the moment they are published on the website https://www.fiscalcenter.org/. By continuing to use the Website or otherwise interacting with the Administration, the User agrees to all terms of this Agreement as currently in force.
